Trevor Ncube has spent years presenting himself as a defender of independent journalism, free expression and the right of the media to scrutinise powerful people.<\/p>\n\n\n\n
That history makes the latest legal battle involving his own publishing company deeply uncomfortable.<\/p>\n\n\n\n
ZimInd Publishers, the company behind NewsDay, The Standard and the Zimbabwe Independent, has taken 36 employees to the High Court demanding US$100,000 in damages over alleged defamatory statements concerning the company and Ncube.<\/p>\n\n\n\n
The defendants include journalists and other staff members.<\/p>\n\n\n\n
According to the court papers, the dispute originates from an all staff meeting held on 5 March 2026 and chaired by Ncube. Employees had allegedly been instructed not to use their mobile phones while he addressed the meeting.<\/p>\n\n\n\n
ZimInd claims that some employees ignored that instruction and subsequently circulated statements portraying the company as cruel and insensitive, accusing it of withholding salaries and portraying Ncube as incompetent and insensitive.<\/p>\n\n\n\n
The company denies those allegations.<\/p>\n\n\n\n
It is seeking US$100,000 in damages, an unconditional apology and retraction, and an order restraining the employees from further publishing or sharing statements considered defamatory.<\/p>\n\n\n\n
The case has not yet been determined by the court.<\/p>\n\n\n\n
That legal fact is important.<\/p>\n\n\n\n
Ncube and ZimInd have every right to defend their reputation, just as journalists and employees have rights to defend themselves and to raise legitimate grievances.<\/p>\n\n\n\n
But legality is not the only issue.<\/p>\n\n\n\n
There is a much larger question of principle.<\/p>\n\n\n\n
What happens when one of Zimbabwe’s best known defenders of press freedom begins using the same type of legal machinery that he himself has described as intimidating when deployed against journalists?<\/p>\n\n\n\n
That question cannot be avoided.<\/p>\n\n\n\n
Only recently, Ncube publicly recounted how President Emmerson Mnangagwa’s lawyers forced NewsDay to retract and apologise over reporting concerning Mnangagwa’s intentions beyond 2028.<\/p>\n\n\n\n
Ncube described the experience in stark terms.<\/p>\n\n\n\n
He said the newspaper had been afraid.<\/p>\n\n\n\n
Afraid of a powerful President.<\/p>\n\n\n\n
Afraid of enormous legal costs.<\/p>\n\n\n\n
Afraid that even defensible journalism could become financially damaging simply because of the expense and pressure involved in fighting a powerful litigant.<\/p>\n\n\n\n
He went further and described that kind of legal pressure as resembling the logic of a SLAPP, a Strategic Lawsuit Against Public Participation, where the process itself can become punishment regardless of the ultimate outcome.<\/p>\n\n\n\n
That is why the present case is so difficult to reconcile with his public position.<\/p>\n\n\n\n
How different does intimidation feel when the demand is not coming from State House but from the boardroom?<\/p>\n\n\n\n
How different does fear become when it is not a president threatening a newspaper with expensive litigation, but a major publishing company demanding US$100,000 from its own employees?<\/p>\n\n\n\n
How different is the chilling effect when those facing the lawsuit include journalists whose profession depends on speaking, recording, investigating and communicating uncomfortable information?<\/p>\n\n\n\n
The legal circumstances are not identical.<\/p>\n\n\n\n
Mnangagwa is the President of Zimbabwe and possesses the enormous power of the state behind him.<\/p>\n\n\n\n
Ncube is a private media proprietor pursuing a civil claim.<\/p>\n\n\n\n
That distinction matters.<\/p>\n\n\n\n
But differences in power do not erase the question of principle.<\/p>\n\n\n\n
If ruinous legal threats are wrong because they silence scrutiny when politicians use them, media owners must be extremely careful about using litigation in a way that could produce the same fear among journalists and employees.<\/p>\n\n\n\n
Press freedom cannot mean freedom for newspaper owners to investigate presidents while employees inside those same newspapers become terrified to speak about conditions in their own workplace.<\/p>\n\n\n\n
Independent journalism is not simply a relationship between reporters and government.<\/p>\n\n\n\n
It is also a culture.<\/p>\n\n\n\n
It requires organisations in which journalists can challenge authority, ask uncomfortable questions and raise concerns without automatically fearing financial destruction.<\/p>\n\n\n\n
That does not give anyone a licence to defame another person.<\/p>\n\n\n\n
If false allegations were deliberately circulated, those accused of publishing them can be asked to account for what they said.<\/p>\n\n\n\n
But the scale and nature of the response still deserve scrutiny.<\/p>\n\n\n\n
Thirty six employees.<\/p>\n\n\n\n
US$100,000.<\/p>\n\n\n\n
Public retractions.<\/p>\n\n\n\n
Apologies.<\/p>\n\n\n\n
And an order seeking to prevent further allegedly defamatory publication.<\/p>\n\n\n\n
For a media organisation whose existence has been shaped by battles against censorship and intimidation, that is an extraordinary position to occupy.<\/p>\n\n\n\n
Ncube knows better than most what legal intimidation can do to journalism.<\/p>\n\n\n\n
He has publicly recounted his own history of confrontation with Robert Mugabe’s government.<\/p>\n\n\n\n
He has written about editors being tortured.<\/p>\n\n\n\n
He has described the intimidation faced by the Zimbabwe Independent.<\/p>\n\n\n\n
He has spoken proudly of the newspaper’s resistance to authoritarianism.<\/p>\n\n\n\n
His publications themselves have repeatedly challenged powerful politicians, exposed corruption and demanded accountability.<\/p>\n\n\n\n
That legacy creates an even higher standard.<\/p>\n\n\n\n
A newspaper cannot convincingly demand openness from the government while appearing intolerant of internal scrutiny.<\/p>\n\n\n\n
A media proprietor cannot warn that powerful politicians are using litigation to frighten newspapers and then fail to recognise the frightening effect a six figure lawsuit may have on ordinary employees.<\/p>\n\n\n\n
And an organisation that campaigns against censorship must be particularly cautious when asking a court to stop people from publishing further statements.<\/p>\n\n\n\n
The contradiction becomes even more uncomfortable when placed alongside Ncube’s political history.<\/p>\n\n\n\n
After Robert Mugabe was removed in 2017, Ncube was among those who believed Mnangagwa deserved an opportunity.<\/p>\n\n\n\n
He later described Mnangagwa as the “man for the season” and joined the President’s Advisory Council in 2019.<\/p>\n\n\n\n
He eventually changed his position.<\/p>\n\n\n\n
By 2022, he publicly admitted that his optimism had been misplaced and said he believed the Mnangagwa project was not going to end well.<\/p>\n\n\n\n
There is nothing wrong with changing one’s political position.<\/p>\n\n\n\n
People should change their minds when the evidence demands it.<\/p>\n\n\n\n
But Ncube’s journey should have made one lesson particularly clear.<\/p>\n\n\n\n
Power must always be scrutinised, regardless of who holds it.<\/p>\n\n\n\n
That applies to political power.<\/p>\n\n\n\n
It applies to corporate power.<\/p>\n\n\n\n
And it applies to media power.<\/p>\n\n\n\n
There is another layer that makes scrutiny important.<\/p>\n\n\n\n
Alpha Media Holdings has itself become entangled with politically connected interests.<\/p>\n\n\n\n
Gerald Mlotshwa, President Mnangagwa’s son in law, acquired a substantial stake in AMH, reported at 39 percent, and appointed a representative to the company’s board.<\/p>\n\n\n\n
That does not prove that ZANU PF controls AMH.<\/p>\n\n\n\n
It does not establish that government officials determine editorial content.<\/p>\n\n\n\n
Such claims would require evidence.<\/p>\n\n\n\n
But it demonstrates why transparency, independence and consistency matter enormously for a media organisation operating in Zimbabwe’s highly politicised environment.<\/p>\n\n\n\n
The credibility of independent media depends not only on what it publishes about politicians but on whether it applies the principles it demands from politicians to itself.<\/p>\n\n\n\n
Zimbabwe has experienced decades in which journalists have been arrested, threatened, sued, harassed and pressured because their work challenged powerful interests.<\/p>\n\n\n\n
Successive governments, particularly under ZANU PF, have faced sustained criticism from journalists, media organisations and rights groups over restrictions on press freedom and the broader chilling environment surrounding critical reporting.<\/p>\n\n\n\n
That history should make independent media institutions allergic to anything that even resembles censorship by intimidation.<\/p>\n\n\n\n
The argument should never become that because Ncube is not the government, anything his company does is automatically acceptable.<\/p>\n\n\n\n
The standard must be higher than that.<\/p>\n\n\n\n
If the principle is that powerful people should tolerate scrutiny, then powerful media proprietors should tolerate scrutiny too.<\/p>\n\n\n\n
If journalists should be free to interrogate politicians, they should also be able to raise legitimate concerns about the institutions employing them.<\/p>\n\n\n\n
If costly litigation can chill speech when wielded by presidents, the same possibility must be considered when it is wielded by employers.<\/p>\n\n\n\n
Ncube has spent much of his career confronting the culture of powerful people demanding silence.<\/p>\n\n\n\n
That is precisely why this case matters.<\/p>\n\n\n\n
The issue is bigger than Trevor Ncube.<\/p>\n\n\n\n
It asks whether Zimbabwe’s independent institutions can genuinely practise the democratic values they demand from the state.<\/p>\n\n\n\n
A free press cannot merely oppose censorship when censorship comes from ZANU PF.<\/p>\n\n\n\n
It must oppose the culture of silencing wherever it appears.<\/p>\n\n\n\n
Even when the criticism is uncomfortable.<\/p>\n\n\n\n
Even when the target is a media proprietor.<\/p>\n\n\n\n
And especially when the people facing the consequences are journalists themselves.<\/p>\n\n\n\n
If Zimbabwe is ever going to escape the political culture in which powerful people use fear to control those beneath them, the principle must be universal.<\/p>\n\n\n\n
No politician should be above scrutiny.<\/p>\n\n\n\n
No businessman should be above scrutiny.<\/p>\n\n\n\n
